Can I have my bank charges refunded even when these charges are stated in the terms and conditions when I set up my account with the bank?

Can I reclaim bank charges from an account that is now closed?

Will my bank close my account if I claim back these charges?

Some banks have taken this stance. However, The Banking Code Standards Board has advised Banks "to ensure that they do not make a disproportionate response to customers claiming back these 'default' fees and treat the customers sympathetically and positively in accordance with the provisions of Banking Code section 14."

The Financial Ombudsman Service has also criticised at least one bank for this practice, but it is unclear whether the banks will comply with this.

As a precautionary measure, it is recommend that all claimants open a new bank account that can be used in the event of the bank taking this course of action



Could I make a claim on my own?

Yes of course you can but keep in mind the following points:

How long will it take?

The time it takes will depend on your bank, but generally a claim takes between three and five months to settle. If your bank will not settle out of court and we need to go to trial, your case may take a little longer to complete.



Will I definitely get my money back?

No, this can never be guaranteed especially with the test case still being expanded on since the news on May the 7th. However, it is more than likely that you will get your money back; apart from the odd case where a bank has refused to pay, in most other cases, banks have settled out of court to avoid going to trial.
